The present appeal has been filed under Section 13 of the Commercial Courts Act, 2015, read with Section 96 and Order 41 of the CPC, 1908, assailing the Judgment and Decree dated 23.12.2025, passed by the learned Single Judge of this Court in CS (COMM) 1059/2025. 4.

Heard learned counsel for the parties.

Learned Senior Counsel for the appellant submits that the sole grievance is with regard to certain observations made by the learned Single Judge in the impugned order as the same may impact his rights with regard to his other suits filed against the defendants and/or other persons before different Courts.

He submits that these observations made in the impugned order are only with regard to the prayer made on the basis of the pleadings in the suit bearing No. CS(COMM) 1059/2025.

Learned Counsel for the respondents submits that they have no objection in case it is clarified that such observations made in the impugned order are only with regard to the prayer made on the basis of pleadings in the suit bearing No. CS(COMM) 1059/2025.
