% 09.10.2019 Learned counsel for the petitioner has prayed for suspension of the order dated 26.09.2019 passed by Ld. MM Harun Pratap, Saket Courts, District South East, New Delhi in application for release of passport and permission to go abroad in FIR No. 87/2017 P.S.: Chitranjan Park to the extent of issuance of notice to the complainant and fixing next date of hearing to be 01.11.2019 and further seeking release of passport and permission to go abroad.

Learned APP for the State has filed the status report. Learned counsel for the petitioner prays that because of long date

given by the learned MM, the very purpose of moving the application will be frustrated. He further states that learned MM is not empowered to issue notice to the complainant at the time of the hearing of the application for permission to go abroad.

Learned counsel for the complainant on the other hand states that the complainant has a right to appear and oppose the application. Heard. Let the date of hearing be preponed to 15.10.2019, otherwise the very purpose for filing the application by the petitioner will be frustrated. Learned counsel for the petitioner as well as complainant state that they will make their submissions before the Ld. MM on the issue whether complainant should be heard on the application or not. Parties are directed to appear before the Ld. MM on 15.10.2019 at 2:00 PM who will decide the application as expeditiously as possible.
