O R D E R

The petitioner has filed the present petition, inter alia, seeking bail in connection with FIR No. 0034/2018 under Section 304 of the IPC registered with PS Sagar Pur.

The said FIR was registered at the instance of the widow of the deceased. She stated that her husband was a chronic alcoholic and was unemployed. On 22.02.2018 at about 05:00 p.m., her husband had asked her to bring their son from tuition and informed her that he was going to his mother's house. However, her husband did not return. She went to her mother-in-law's house and saw that in the street, near her mother in law's house, the petitioner (accused) was quarrelling with her husband. She alleged that the petitioner was also holding a bottle of liquor in his hand and during the quarrel, he had filled his mouth with liquor and had spat the same on her husband. She states that since his husband was smoking a bidi, the liquor fell on his face and clothes, due to which his clothes and the upper

portion of his body caught fire and his face and chest got burnt. 3.

The petitioner claims that subsequently, different versions of events have been asserted/reported. This is disputed by Ms Dhalla, learned APP for State.

All the material witnesses have been examined. The petitioner has been in custody for approximately twenty-two months. 5.

In view of the facts obtaining in this case, this Court considers it apposite to allow the present petition.

Accordingly, it is directed that the petitioner be released on bail on his furnishing a personal bond in the sum of ₹20,000/- with one surety of an equivalent amount to the satisfaction of the concerned Trial Court. 7.

The petitioner shall not leave the National Capital Territory of Delhi and he shall report to the local police station (PS Sagar Pur) on every second and fourth Monday of each calendar month at 10:30 a.m. He shall also provide his mobile number and ensure that he is reachable on it at all times. 8.
