The present petition under Article 227 of the Constitution of India has been filed for seeking direction to GDA / NCLAT to release compensation to the petitioners herein out of penalty amount of Rs. 1,00,60,794/- with interest @ 10.5% thereon already imposed on GDA for non-delivering possession at final cost of Rs. 2 lac to the petitioners, and also for seeking direction to deliver possession forthwith to the petitioners, pending their appeal before learned NCLAT, New Delhi.

Learned counsel for petitioners submits that petitioners have moved an application under Section 151 of the Code of Civil Procedure ("CPC") for release of compensation before the learned NCLAT which is pending for disposal, which may be decided within two weeks. 3.

Learned counsel for petitioners is at liberty to make the submissions before the learned NCLAT.
