Mr. Bishwajit Dubey, who appears for respondent No.1 bank i.e. Bank of Baroda ("BOB"), submits that he has instruction to convey to the Court that the impugned order dated 18.9.2019 passed by the Review Committee and the communication dated 3.10.2019 will be withdrawn. 1.1 Learned counsel further submits that although the communication dated 14.5.2018 is not impugned in this writ petition, the same will also be withdrawn.

1.2 It is also the submission of the learned counsel that the company i.e. AAP Infrastructures Ltd. and Mr. Anjanee Kumar Lakhotia will have liberty to make a representation before the Review Committee within a period of 15 days from today in terms of the judgment rendered by the Supreme Court in W.P.(C) 11306/2019 1/2

The statement of counsel for respondent No.1 bank/ BOB is taken on record.

The Review Committee, after hearing AAP Infrastructures Ltd. and Mr. Anjanee Kumar Lakhotia, will pass a speaking order keeping the directions contained in the aforementioned judgment in mind. 4.

In the meanwhile i.e. till a decision is rendered by the Review Committee, the name of respondent No.3 will be removed from the list of wilful defaulters vis-a-vis AAP Infrastructures Ltd. 5.

In these circumstances, nothing survives in the instant petition. The captioned writ petition is disposed of in the aforementioned terms. 6.
