• Issue an appropriate writ, order or direction, including a writ in the nature of mandamus, quashing and setting aside the impugned Recovery Orders, all three dated 17.09.2025, issued by Respondent No. 3, all of which direct recovery of • Rs. 11,45,207.83/- from Petitioner No. 1, • Rs. 39,86,838.13/- from Petitioner No. 2, and • Rs. 11,86,510.41/- from Petitioner No. 3;
i. Issue an appropriate writ, order or direction in the nature of mandamus restraining the Respondents from effecting any recovery from the salary, allowances, or service benefits of the Petitioners pursuant to the impugned Recovery Orders dated 17.09.2025;
ii. Issue an appropriate writ, directing the Respondents to reverse any amount recovered from the Petitioners in furtherance of the recovery orders dated 17.09.2025;
iii. Issue an appropriate writ, order or direction directing the Respondents to furnish to the Petitioners copies of the Court of Inquiry report, findings, conclusions, and all documents/material relied upon for issuance of the impugned Recovery Orders; iv. Pass such other or further order(s) as this Hon'ble Court may deem fit and proper in the facts and circumstances of the present case."

Though several grounds have been raised in the writ petition, one of the grounds urged by the counsel for the petitioners is that the respondents have passed the impugned recovery orders all dated 17.09.2025 for recovery of Rs. 11,45,207.83/-, Rs. 39,86,838.13/- and Rs. 11,86,510.41/- from the petitioners without issuing a show cause notice and also without furnishing the report of the Court of Inquiry to the petitioners to enable them to contest the action of the respondents.

According to the learned counsel for the petitioners, this itself is an infirmity in the impugned action of the respondents and is liable to be set The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned counsel appearing for the respondents on instructions submits that a show cause notice shall be issued by the respondents to the petitioners along with the report of the Court of Inquiry so as to enable the petitioners file their reply for the respondents to pass a speaking and a reasoned order in accordance with law.

Accordingly, the impugned orders(s) dated 17.09.2025, in respect of all the three petitioners is set aside. Liberty shall be with the respondents to issue a show cause notice along with the report of the Court of Inquiry, within two weeks from today, to enable the petitioners file their reply within two weeks thereafter both on facts and in law, for the respondents to pass a detailed and a speaking order in accordance with law within four weeks of the filing of reply.

The petition is disposed of. Pending application is disposed of as infructuous.
