The present petition has been listed in the supplementary cause list during the course of the day pursuant to urgent mentioning before Hon'ble the Chief Justice.

By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 229/2024, registered at Police Station Dayalpur under Sections 380/448/457/506/34/120-B of the Indian Penal Code, 1860, on the ground that the disputes between the parties have been amicably settled. 3.

Upon a query by this Court with regard to the urgency in the matter, Mr. Manish Kumar, learned counsel for the petitioners as well as Ms. Seema Singh, learned counsel for the complainants, submit that petitioner No. 1 is required to surrender today, in terms of the order dated 15.01.2026 passed by the Supreme Court, whereby her bail was cancelled.

proceedings in the present petition, filed after the order was passed. The petition bears the date 19.01.2026, and is supported by an affidavit dated 21.01.2026. It is incumbent upon a party invoking the inherent powers of this Court to place before it all material and relevant facts, which would include orders passed by the Supreme Court in the very same proceedings. The observations of the Supreme Court may have a bearing upon the exercise of discretion by this Court with regard to quashing on the grounds of settlement. I am informed that the said order has not yet been made available to the parties. Be that as it may, the petition ought to have contained the requisite disclosures and appropriate averments in this regard.

In the absence of the order passed by the Supreme Court having been placed on record, I do not consider it appropriate to entertain the present petition at this stage.

At this stage, however, Mr. Kumar seeks permission to withdraw the present petition, with liberty to the petitioners to avail appropriate remedies either before the Supreme Court or before this Court, upon the order of the Supreme Court being made available. 7.

In view of the aforesaid submissions, the petition, alongwith the pending applications, is dismissed as withdrawn, in terms of this submission.
