ARB.P. 718/2019 This petition has been filed by the petitioner with the following prayers:
"It is, therefore, most respectfully prayed that the Hon'ble Court may graciously be pleased to:
I. Appoint an Arbitrator who should preferably be a Retd. Judge of Delhi High Court and residing in Delhi, as the Arbitration proceeding are held in Delhi. II. Pass any other appropriate order which the Hon'ble Court deem fit in the facts and circumstances of the case."
As noted from the petition and contended by the learned counsel for
the parties, it is the nominee Arbitrator on behalf of the respondent who has expired and accordingly a substitute Arbitrator needs to be nominated by the respondent.
Learned counsel appearing for the respondent on advance notice states, a nominee Arbitrator shall be appointed by the respondent within three weeks. Learned counsel appearing for the petitioner is agreeable to the statement made by the counsel for the respondent. Let a nominee Arbitrator be appointed by the respondent within three weeks.
The petition stands disposed of.
