The learned counsel appearing for respondent no. 2 states that he has also challenged the order dated 08.10.2020, as impugned before this Court, before the learned Sessions Judge also, which is pending for adjudication. 2.
The learned senior counsel appearing for the petitioner states that he had directly approached this Court and had not challenged the impugned order before the learned Sessions Court.

In this Court‟s opinion, it will be appropriate if the petitioner herein first exhaust all the remedies available in law and approach the learned Sessions Court, as the impugned order is a revisable order. He, however, states that the present petition has been filed in time before this Court and in case, he will approach the learned Sessions Court, there will be an issue of limitation.

In these circumstances and keeping in view the no-objection given by the learned counsel for respondent no. 2, it is ordered that delay, if any, in filing the petition before the learned Sessions Court, which he will file within two weeks from date, will not come in the way of adjudication, since the order was challenged before this Court within time. 5.
Further, considering that the petitioner was granted exemption from personal appearance, considering his age about 77 years and is a foreign national, the exemption granted will continue before the learned Sessions Court till his application, for the said exemption, is decided by it. 6.
With these directions, petition stands disposed of. Pending application, if any, also stands disposed of. 7.
