versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ANR.

..... Respondents Through Mr.Kishan Nautiyal, Adv.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 20.03.2018 Vide the present petition, the petitioner has impugned the order dated 2nd December, 2016 passed by respondent no.1 as also the decision taken in the minutes of the meeting dated 28th-30th June, 2016, passed by the respondent nos.1 & 2 respectively whereby the petitioner‟s application for B.A. B.Ed./B.Sc.B.Ed. integrated course for the academic session 2018-19, was rejected. Learned counsel for the respondents is unable to dispute the position that the matter is squarely covered by a decision of this Court in WP (C) No.3231/2016 titled Rambha College of Education Vs. National Council for Teacher Education & Anr., which judgment has attained finality as the Special Leave Petition filed by respondent against the aforesaid decision before the Supreme Court stands rejected.

Accordingly, the impugned order dated 2nd December, 2016 whereby the petitioner‟s application was rejected on the sole ground that the NOC from the affiliating University was submitted to the respondents after the cut-off date, is liable to be quashed and the same is, accordingly, set aside.

The respondents are directed to re-process the petitioner‟s application for the relevant academic year and pass an appropriate order within six weeks from today.

The petition is disposed of in the aforesaid terms. REKHA PALLI, J MARCH 20, 2018/aa
