The present petition has been filed by the petitioners challenging the Provisional Attachment vide order dated 01.05.2025 passed by Directorate of Enforcement.

The relief clause of the petition reveals that the petitioners seek this writ Court to exercise powers under Section 8(8) of Prevention of Money Laundering Act, 2002. (PMLA).

The petitioners do not dispute that they have remedies under Section 8 and Section 43 of the PMLA. However, the said remedies are stated to be not efficacious and are consuming considerable time. It is for this reason the petitioners have approached this Court.

Mr. M.L. Lahoty, learned counsel also points out that at the instance of one Mr. Ashish Bhalla and others, this Court has entertained the W.P.(C). 12043/2025, where, the Provisional Attachment Order in ECIR dated 01.05.2025 has been assailed by the promoters. 6.

It is seen that if the petitioners have any grievance with respect to writ W.P.(C). 12043/2025, they are at liberty to file appropriate application seeking their impleadment or intervention therein. 7.

If the prayer in the instant petition is perused, the same is to be exercised by the concerned Court under Section 8(8) of the PMLA. The petitioners seem to have approached the concerned Court and the matter is pending. The Court, at this stage, observes that if the petitioner has taken recourse to Section 8(8) of the PMLA, let the request of the petitioners be expedited and the matter be taken to its logical conclusion with due expedition, considering the involvement large number of home buyers. 8.
