% 13.04.2017 By this writ petition under Article 226 of the Constitution of India, petitioner has prayed for transfer of investigation to DIU/Economic Offences Wing. Petitioner has also prayed for grant of compensation and is seeking directions to the respondent no. 1 to initiate action against the respondent nos. 2 and 3 for dereliction of duties. It is contended that the FIR was not registered promptly and investigations are also not conducted properly. Accused persons have not been arrested. I have perused the status report.

It is clear that petitioner had approached the court of learned Metropolitan Magistrate, Delhi and pursuant

to the directions dated 17th March, 2016 passed in the complaint case filed under Section 156(3) of the Cr.P.C., FIR No. 113/2016 under Sections 420/120-B IPC was registered at Police Station Tilak Marg. It has been pointed out that one of the accused has already been arrested on the basis of secret information and is in custody.

I am satisfied that the investigations are being carried out in a proper manner. I find no reason to transfer the investigations to the DIU/Economic Offences Wing. I also do not find the respondent nos. 2 and 3 to be, prima facie, guilty of any dereliction of duties. No ground is also made out for grant of any compensation to the petitioner, as these actions are being taken, in accordance with law. Petition is dismissed.

Miscellaneous application is disposed of as infructuous.
