% 21.02.2018 Petitioner had been acquitted by judgment of the Session Judge on 01.05.2015 on the charges levelled against him under Sections 376(2)(g)/506 read with Section 34 of the IPC. It is pointed out that in the course of recording his acquittal, the trial judge ordered a departmental inquiry to be initiated against respondent No. 3 / investigating officer / the then SHO.

On advance notice, learned counsel for the State has put in appearance. It is stated that against the judgment dated 01.05.2015, State had filed an appeal and leave to appeal had been granted. The petition for leave to appeal has now been registered as Crl. Appeal No. 659/2015. It stands admitted. It is listed in regular course. This petition is disposed of with liberty granted to the petitioner to move an appropriate application in Crl. Appeal No. 659/2015, if so required.
