The instant application under Section 439 of the Code of Criminal Procedure, 1973 ('Cr.P.C') has been filed on behalf of applicant seeking grant of interim bail in case FIR bearing no.09/2017, registered at Police Station Special Cell, Delhi for offences punishable under Sections 22/29 of Narcotic Drugs and Psychotropic Substances Act, 1985 ('NDPS Act') for a period of ten days.

Learned counsel for the applicant argues that the applicant is before this Court to seek interim bail for a period of 10 days on humanitarian grounds. It is argued that applicant was granted interim bail vide order dated 28.04.2023 for a period of 15 days on the ground of performing last rites of his father's death and after expiry of the same, he has duly surrendered before the concerned authority. It is argued that marriage of the real brotherin-law (who is also the parokar of the applicant) is to take place, and the applicant herein seeks an interim bail to attend his wedding. 6.

The marriage of real brother-in-law of the applicant has been verified. 7.

Learned APP for the State, on instructions from the Investigating Officer, submits that the applicant was also granted interim bail for a period of 15 days on account of performing last rites of his father's death and had duly surrendered thereafter. It is submitted that the factum of marriage of the brother-in-law of the applicant has been verified by the State. 8.

In light of the circumstances of the case, and also the fact that the applicant was also granted interim bail after which he had duly surrendered, this Court is inclined to grant interim bail to the applicant for a period of 07 days on humanitarian grounds and on the same terms and conditions which were imposed vide order dated 28.04.2023.

Accordingly, the present application stands disposed of. 10.
