Issue notice. Mr Lao, learned ASC appearing for the State accepts notice.

The petitioner has filed the present petition, inter alia, impugning an order dated 31.07.2019, whereby the petitioner's application for parole was rejected.

A plain reading of the impugned order indicates that the petitioner's application for parole was rejected since he had surrendered one day late (that is on 27.01.2019) after availing furlough for two weeks, with effect from, 11.01.2019 to 26.01.2019.

The learned counsel appearing for the petitioner states that the delay

was on account of certain mitigating circumstances, which have been explained.

Mr Lao also states that the status report has been filed. The status report indicates that the address has been verified. 7.

In view of the above, this Court considers it apposite to allow the present petition.

The same is allowed.

The petitioner is directed to be released on parole for a period of four weeks from the date of his release. This is subject to the petitioner furnishing a Personal Bond in the sum of ₹10,000/- and a surety of an equivalent amount to the satisfaction of the Jail superintendent.
