When asked, learned counsel for petitioner, in all fairness, submitted that the complainant has though entered into witness box but has not been completely examined so far.

After some arguments, learned counsel for petitioner, without prejudice to his rights and contentions, does not press the present application at the stage. He, however, seeks liberty to file the application afresh once the complainant is examined and discharged.

In view of the above submission made by the learned counsel for petitioner, the present application is disposed of as not pressed. 4.
Liberty, as prayed, is granted.
