The present petition has been filed under Article 227 of the Constitution of India for setting aside the order dated 05.10.2023 passed in CS No. 180/2020 titled 'Savita v. Rajender Kumar' by the Civil Judge-03, South West, Dwarka, Delhi (hereinafter referred as 'Trial Court'), whereby the learned Trial Court allowed the application under Section 45 of the Indian Evidence Act filed by the respondent no.1 herein. The petitioner herein is the defendant no.2 before the learned Trial Court. 4.
After making submissions, learned counsel for the petitioner seeks to withdraw the present petition.
