1. Allowed, subject to all just exceptions. The application is disposed of. W.P.(C) 11614/2019 and C.M.No. 47710/2019 (Stay)

2. The present petition has been filed assailing the order of the Debt Recovery Appellate Tribunal, declining to entertain the Petitioner‟s appeal due to failure to make the pre-deposit. The DRAT rightly rejected the offer of the Petitioner that they would surrender an immovable property instead of making a pre-deposit.

3. Learned counsel for the Petitioners states that property being offered is right now unencumbered. It will be open to the Petitioners to raise money

by putting the said property to sale and again approaching the DRAT with an appropriate application.

4. The writ petition is dismissed in the above terms. The pending application also stands disposed of.
