By way of present petition, the petitioner seeks quashing of FIR No. 549/2020 registered under Sections 325 IPC at Police Station Punjabi Bagh, Delhi on the ground that the parties have amicably settled their disputes. 2.

As per the allegations levelled in the FIR, the petitioner pushed the late respondent No.2 from stairs on account of a dispute over pending dues. 3.

It is informed that the complainant/victim has since expired on 21.09.2020 and is represented through his legal heirs, who are impleaded as respondent Nos. 3 to 5.

Learned APP for the State, on instructions, submits that the petitioner is the only accused and respondent No. 3 to 5 are the legal heirs of complainant/victim in the present case. Learned counsel for the petitioners submits that the petitioner and respondent Nos. 3 to 5 with the intervention of family members and friends, have amicably settled their disputes vide Compromise Deed/Memorandum of Understanding dated 23.12.2023, a copy of which has been placed on record. In terms of the said settlement, it was agreed that a sum of Rs.1,00,000/- as full and final settlement shall be paid by the petitioner to respondent Nos. 3 to 5. The amount of Rs.1,00,000/- is being paid today to respondent No. 2 (widow of deceased complainant/victim) through a demand draft bearing No. 634172, dated 18.10.2024, drawn on Kotak Mahindra Bank, Punjabi Bagh, Delhi, a photocopy of which has been placed on record. In terms of the said settlement, legal heirs of the complainant are now left with no claim or grievance against the petitioner. 6.

The petitioner and respondent Nos. 2 to 5, who are present in Court, have been identified by their counsel as well as the I.O./ with WSI Savita and HC Shashi Kumar, PS Punjabi Bagh, Delhi who is present in the Court. 7.

The petitioner has shown remorse for his conduct and undertakes not to repeat the same in future. Respondent Nos. 3 to 5 also state that they have entered into the aforementioned MOU out of their own free will, volition and without any coercion. They further state that they have no objection if the present FIR and consequent proceedings are quashed, subject to encashment of the demand draft of Rs.1,00,000/- handed over today. 8.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and considering that no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

FIR and the consequent proceedings arising therefrom are hereby quashed, subject to encashment of the demand draft of Rs.1,00,000/- handed over to respondent No. 2 today.
