The petitioners seek quashing of FIR No. 448/2009 under Sections 420/406/506/120-B of the IPC Police Station Krishna Nagar, Delhi. The allegations in the FIR emanate out of the transaction for purchase of a property. It is contended that an advance of Rs. 9.50 lakhs was paid for purchase of the property which subsequently was found to be mortgaged.

Learned counsel for the petitioners as well as respondent no. 2 who is present in Court in person and is identified by the IO submits that a settlement has taken placed between the parties consequent to which the respondent no. 2 has received Rs. 3,00,000/- from the petitioners. Respondent no. 2 was also to receive a sum of Rs. 3 lakhs from one Rakesh Rana who has since expired. Respondent no. 2 submits that from petitioners, she had to receive a full amount of Rs. 3 lakhs which has now fully and finally been received and as such she CRL.M.C. 80/2018
does not wish to press charges against the petitioners any further and she has no objection for quashing of the FIR. 3.
In view of the fact that the subject FIR emanated out of financial transaction and a settlement has taken placed between the parties consequent to which the respondent no. 2 has received the agreed amount from the petitioners and does not wish to prosecute the complaint any further, no fruitful purpose would be served in continuing the criminal proceedings and it would be in the interest of justice that the dispute between the parties are put to an end and peace is restored. It would be expedient to quash FIR No. 448/2009 under Sections 420/406/506/120-B of the IPC Police Station Krishna Nagar, Delhi, Delhi and the consequent proceedings emanating therefrom.

In view of the above, the FIR No. 448/2009 under Sections 420/406/506/120-B of the IPC Police Station Krishna Nagar, Delhi and consequent proceedings arising out of the same are quashed. 5.
