After hearing arguments for some time, learned counsel for the petitioner seeks to withdraw the present petition while supplementing that the petitioner would file appropriate application under Order XXXIX Rule 2A CPC seeking appropriate action in relation to the defiance of the specific order passed by learned Civil Judge. He, however, states that, in case, need so arises, the petitioner may be granted liberty to file the contempt petition afresh. 2.
In view of the above statement, the present petition is disposed of as not pressed. Liberty, as prayed, is granted. 3.
It is clarified that this Court has not expressed any opinion on the merits of the case as such.
