O R D E R

This petition has been filed with the following prayers:- "1. Issue a Writ of Mandamus/ Certiorari or any other appropriate Writ quashing/setting the Detailed Medical Examination result dated . 19.11.2025 and Review Medical Examination result dated 20.11.2025.

2. Pass an order to consider the reports of independent hospitals as stated herein above for the purpose of medical examination or direct it to be conducted by an independent hospital such as AIIMS or similar hospital.

3. Pass an order to reserve a vacancy for the Petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

In effect, the petitioner is challenging the conclusion drawn by the Detailed Medical Examination ("DME") and the Review Medical Examination ("RME") whereby the petitioner has been found unfit on the ground of defective distant vision.

At the outset, learned counsel for the petitioner states that the ITBP through Director General, CGO complex, Lodhi Road, New Delhi be impleaded as a party/respondent. It is ordered accordingly. The amended memo of parties be filed by tomorrow.

The learned counsel for the petitioner has drawn our attention to both the conclusions drawn by the DME and RME. He has also drawn our attention to the routine examination carried out at AIIMS, New Delhi, Dr. Ram Manohar Lohia Hospital and Dr. Baba Saheb Ambedkar Hospital, to contend that as per their reports the petitioner has a normal eye sight. 5.

Having heard to the learned counsel for the parties, we are of the view that the interest of justice would be served if the petitioner is referred to the Army R&R Hospital, Delhi to enable the R&R Hospital examine the vision of the petitioner. While checking, the Board at R&R Hospital shall consider the reports of the DME and RME and of AIIMS, RML Hospital and Dr. Baba Saheb Ambedkar Hospital.

The Board shall give its opinion to the Director General of the IndoTibetan Border Police to enable the said authority consider the report and proceed, in accordance with law.

The petitioner shall produce the present order along with relevant documents as referred to above for consideration of the Board at R&R The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Hospital to enable the Board take action in terms of this order. 8.

Suffice to state that the outcome of the medical examination pursuant to this order shall be final and binding on the parties. 9.

The petition is, accordingly, disposed of.
