This petition is filed under Section 11 of the Arbitration and Conciliation Act, 1996 for appointment of the Arbitrator for resolution of the disputes between the parties.

The brief facts are that the Service Agreement and the Supplementary Master Service Agreement were executed on 31.05.2023 between the parties. The petitioner is a non-banking financial company engaged in providing financial assistance and lending services including financing of electric vehicle. The respondent is a service provider engaged in sourcing of customers, collection and recovery services.

dispute resolution through arbitration. A legal notice by both the parties for invoking the arbitration was served on 02.12.2025.The attempt to resolve the issue failed. Hence, the present petition is filed. 3.

Learned counsel for the respondent appearing on advance notice on instructions submits that a counter claim is to be filed and there is no objection to appointment of the arbitrator. 4.

Accordingly, the petition is allowed by appointing Justice Mr. CJ Ravi Shankar Jha (Retd.) (Mobile No.9425153362), with the consent of the parties, as the sole arbitrator for adjudication of the disputes which have arisen between the parties. 5.

Arbitral proceedings will be held under the aegis of Delhi International Arbitration Centre (DIAC). Fee of the Arbitrator shall be fixed as per fee schedule.

Before entering upon reference, the learned Arbitrator will comply with Section 12 of the Act.

It is made clear that since this Court has not expressed any opinion on the merits of the rival claims of the parties, it will be open for the parties to file their respective claims/counter claims before the learned Arbitrator which will be considered in accordance with law. 8.

A copy of this order be forwarded to the learned Arbitrator for information.
