The prayer in W.P.(C) 923/2025 is for release of amount in terms of the supplementary award dated 28th April, 2017, along with interest and the prayer in W.P.(C) 1063/2025 is for release of the balance award amount of Rs. 7,62,040/- along with interest.

The background of the case is that in W.P.(C) 923/2025 the Petitioner's land was notified for acquisition u/s 4 of the Land Acquisition Act, 1894 on 21st March, 2003. In W.P.(C) 1063/2025, the said notification for acquisition was issued on 19th February, 2010.

Thereafter, a declaration under Section 6 was issued and award no. 12/2005-06/DC(NW) was passed in W.P.(C) 923/2025 on 19th March, 2004. In W.P.(C) 1063/2025, award no. 03/2010-11/DC(NW) was passed on 1st July, 2011.

The possession of the respective lands was taken, however, there were also a large number of trees and rose bushes which were also taken over by the LAC.

In W.P.(C) 923/2025, supplementary award was then passed on 28th April, 2017 in favour of the Petitioner, granting an amount of Rs. 37,65,785/- to be paid to the Petitioner. The present petition has thus been filed by the Petitioner seeking the payment of this amount, along with interest. 7.

In W.P.(C) 1063/2025, an amount of Rs. 22,96,666/- is stated to have been given to the Petitioner in view of the award no. 03/2010-11/DC(NW) was passed on 1st July, 2011. Thereafter, the Petitioner is stated to have filed repeated representations for release of the remaining 20% of the total amount. Hence, the Petitioner has filed W.P.(C) 1063/2025, seeking the grant of said remainder amount, along with interest.

Ld. Counsel for the Petitioner submits that the Petitioner is 90 years old and therefore, the payment of interest be directed to be paid on an early date.

On the other hand, ld. Counsel for the Respondent- LAC submits that interest in terms of the statute under Section 24 of the Land Acquisition Act would only be in respect of the acquired land. Insofar as the award relating to trees, orchids, plants etc. is concerned, the interest thereon would only be as per the prevailing bank rates.

Be that as it may, since the principal amount has already been released to the Petitioner, let the interest be computed by the LAC as per law under both Awards and the same be released to Petitioner within 4 months. 12.

Both the petitions are disposed of in said terms, along with pending applications, if any.
