O R D E R

The petitioner has filed the present petition, inter alia, seeking anticipatory bail in regard to FIR No.0034/2019, under Sections 420/468/471/34 of the IPC, registered at PS Uttam Nagar. The said FIR was registered at the instance of Mr Nohar Chand Mittal (the complainant). The allegation in the present case relates to a property (land measuring 28.5 sq. yards out of Khasra No.79, Om Vihar, Phase-III). 2.

It is alleged that the petitioner along with one Ranju Devi had prepared title documents in respect of the said property to defraud its rightful owners. The petitioner claims to have purchased the said property

from Ranju Devi. She in turn claims to have purchased the same from Shri Satya Prakash, who has since expired. The learned counsel appearing for the State states that investigations are being conducted and neither the petitioner nor Ranju Devi have been able to produce the original documents of title to the property in question.

At this stage, it is not necessary for this Court to examine the investigation in detail. The petitioner had already joined the investigation. Insofar as the original documents are concerned, it is also stated that prior to the FIR being lodged, he had already registered a Non Cognizable Report (NCR) regarding loss of original documents.

This petition was listed on 07.11.2019. However, this Court had not granted the prayer as sought as it was represented by the learned counsel appearing for the complainant that the complainant has been receiving threats from the petitioner. He also requested time to produce the transcript of the same. However, no such transcripts have been produced. In view of the above, this Court does not consider it apposite to defer the hearing any further.

The petitioner is granted anticipatory bail on furnishing a Personal Bond in the sum of ₹25,000/- and two sureties of an equivalent amount to the satisfaction of the Investigating Officer. This is also subject to the condition that the petitioner shall join the investigation and cooperate fully with the Investigation Officer. The petitioner shall not leave the National Capital Territory of Delhi.

The petitioner shall also provide his mobile number to the Investigating Officer and ensure that he is reachable on it at all times.

It is further clarified that this order shall inure to the benefit of the petitioner till a charge sheet is filed.
