O R D E R

% 09.08.2016 After some hearing, learned counsel for the parties have agreed to settle the matter on the following terms:- (i) The petitioner would pay principal amount of Rs.1,50,000/- towards cost of the basement and other job and equalization charges (recorded as cost of construction in the award dated 11.9.2009).

(ii) The cost of arbitration, parties have agreed, would be borne by the respondent society.

(iii) Towards interest, the petitioner will make a lump sum payment of Rs.1 lac.

(iv) The aforesaid payment will be made within a period of two months from the date of this order.

(v) The petitioner states that he has already paid maintenance charges of Rs.5,600/-.

In view of the aforesaid settlement, we dispose of the writ petition. Parties would be bound by the same. In case the petitioner fails to make payment as agreed, he would be liable to make payment as per the award.
