The present writ petition has been filed by two practicing advocates, praying for grant of mandamus to the respondents to adjudicate and decide the intervention applications. The labour dispute for maternity benefits is pending before respondent no. 2 between one Ms. Reetu Saipawar and a law firm M/s. ACM Legal. It is contended on behalf of petitioners that Ms.Reetu claiming herself to be an employee of ACM Legal has sought maternity benefits, declaring the present petitioners as employees of the said firm. The present petitioners claim that they are not the employees of the firm. Ms.Reetu has not been impleaded here as a party. would not suffer in any manner, whichever way respondent no. 2 decides the dispute. Role of petitioners in such case would be at the most as a witness, if summoned by the law firm or Ms. Reetu.

On being called upon to address on the maintainability of such writ petition, learned counsel for petitioners on instructions of his clients seeks permission to withdraw this petition with liberty to file only a representation before respondent no. 2 that they have been wrongly named as employees of the law firm.

Accordingly, the writ petition and accompanying application are dismissed as withdrawn with liberty as sought.
