O R D E R

The present petition alleges wilful disobedience / non-compliance on the part of the BSF in complying with the directions contained in the judgment / order dated 19.08.2023, passed by learned Judge, Family Courts, South, Saket Courts in Ex.No.117/23 and 185/23. The operative directions therein are as under:

"JD is having permanent Govt. Job despite that he is not paying the arrears of interim maintenance. As the JD is not making the payment of interim maintenance to the DH, therefore, Force Head Quater Directorate General, Border Security Force, Block-I 0, CGO Complex, Lodhi Road, New Delhi is directed to attach Rs.25,000/- per month from the salary of the JD in addition to Rs.35,000/- which is already being attached under the Order of Border Security Force and deposit/credit the same in the account of the DH."

Learned counsel for the respondent / BSF submits that the aforesaid directions are being scrupulously complied with. It is submitted that salary of the concerned person has been attached and duly deposited / credited in the account of the petitioner upto the month of January, 2026. 3.

It is assured and undertaken that even for the future period, as long as the aforesaid direction is subsisting, the respondent shall continue to act in consonance thereof, notwithstanding the transfer of the concerned person. 4.

It transpires that the concerned person, whose salary is attached / remitted to the petitioner, has been transferred to Malda, West Bengal. 5.

It shall be ensured that the records of the concerned person, whose salary is liable to be deducted, are also expeditiously transferred to the concerned local office/ authorities, along with appropriate instructions for attachment of salary to the extent contemplated under the aforesaid order dated 19.08.2023, so as to ensure that the deducted amount is duly credited to the account of the petitioner.

The respondent/s assure that there shall be no failure to comply with the aforesaid directions, even for a single month. 7.

Taking the above statement on record, the petition stands disposed of. 8.

The petitioner shall be at liberty to apprise the concerned local authorities of the BSF in Malda as to the present order.
