Learned counsel for the petitioner submitted that the petitioner has already moved an application under Section 439 of the Code of Criminal Procedure, 1973 (Cr. PC) before the Trial Court for the grant of regular bail, hence, seeks leave of the Court to withdraw the anticipatory bail application, with liberty that in case the application filed under Section 439 Cr.PC is dismissed by the Trial Court, the petitioner shall be moving an application before the Trial Court for grant of time to avail further remedy.

Accordingly, the anticipatory bail application is dismissed as withdrawn, with liberty as prayed. 3.
It is clarified that this Court has not expressed any opinion on the merits of such an application, if any filed by the petitioner, for grant of time to avail appropriate remedy. It is also clarified that this order shall not be construed as grant of
any interim protection, in any manner, to the petitioner. The Trial Court shall decide the application, if any filed by the petitioner, on merits, as per law.
