This hearing has been done through hybrid mode. 2.
The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958 seeks the following prayers: - "(A) allow the revision petition and consequently to; (B) set aside the impugned order dated 18.10.2025 passed by the Ld. court of Sh. Rupinder Singh Dhiman, Rent Controller, Central District, Tis Hazari Courts, Delhi in RC ARC No.258/2024 titled as Rakesh Kumar Gupta vs Iqbal Ahmed whereby the Eviction Petition No. 258/2024 filed by respondent herein has been allowed illegally and m appropriately.
(C) Pass any other or further orders / direction which this Hon'ble Court may deem fit and proper in the fact and circumstances of case and in the interest of justice."

On the last date of hearing, i.e., 05.02.2026, learned counsel appearing on behalf of the petitioner had stated that the subject premises will be vacated by 18.04.2026, and in view of the same, an affidavit of undertaking regarding the same was directed to be filed before the next date of hearing. In pursuance of the said direction, an affidavit of undertaking dated 23.03.2026 on behalf of the petitioner has been filed, wherein, it has been stated as under: - "2.
That the Hon'ble Court was pleased to pass an order on 02.04.2026 thereby directing the petitioner to file the affidavit of undertaking before this Hon'ble Court.

That accordingly the petitioner is filing an affidavit that he will vacate the suit premises on or before 18.04.2026.
4. That the petitioner undertake to continue the pay rent of the suit premises till 18.04.2026.
5. That the petitioner undertakes, that he will maintain suit premises and no damages is done during the period he is possession of the suit premises i.e. till 18.04.2026.
6. The petitioner shall abide by any terms and condition in respect of the suit premises till he vacates the same." 5.
In view of the above, learned counsel appearing on behalf of the petitioner seeks leave to withdraw the present petition. 6.
Leave granted.

The present petition is dismissed as withdrawn and disposed of. 8.
Pending application(s), if any, also stand disposed of. 9.
Needless to state that the petitioner shall abide by the aforesaid undertaking given before this Court.
