This is an application under Section 528 BNSS in disposed of CRL.M.C. 712/2024 seeking directions against respondent no. 2 for compliance of his undertaking filed before the Court and for issuance of contempt proceedings against him.

The Ld. Counsel for the applicant submits that on the basis of undertaking of respondent no. 2 and affidavit, FIR no. 810/2020, PS Khajoori Khas was quashed by order dated 15.05.2024. Despite receiving the entire settlement amount of Rs. 1.04 Crores as per the settlement deed and revised understanding respondent no. 2 has failed to remove the lien and clear the outstanding home loan and handover the original title document of the property within the stipulated 60 days time thereby violating the undertaking and causing financial loss and harassment to the applicant.
