After some arguments, learned counsel appearing for the plaintiff submits that liberty may be granted to him to withdraw the present suit and file a fresh suit, so that the Sale Deed in favour of defendant no. 2 can also be challenged in the suit for partition.

Accordingly, the present suit, along with the pending applications is dismissed as withdrawn, with the aforesaid liberty.
