Appeal under Section 96 of the Code of Civil Procedure, 1908 (CPC) has been filed against the Judgment dated judgement and order dated 14.05.2020 whereby the Suit of the Appellant was dismissed on the ground of limitation. However, the Respondent has already paid the entire principal amount. The dispute only remains about the rate of interest which is claimed to be 18% p.a. by the appellant.

Considering that the Suit was dismissed and the matter has been amicably settled by the Respondent who has paid the principal amount despite dismissal of the Suit of the Appellant, the Court in the appreciation of the fact and that there was no contract between the parties for payment of interest @ 18% p.a., the Court in its discretion grants an interest @ 8% p.a. on the principal amount from 30.10.2013 till the date on which the principal amount was disbursed to the Appellant.

The interest be paid to the Appellant within 60 days, failing which the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 09/03/2026 at 11:26:01
Appellant shall be at liberty to seek the execution. 4.
