ARB. A. (COMM.) 6/2025 is filed by the Petitioner laying a challenge to order dated 04.01.2025 passed by the learned Arbitral Tribunal and ARB. A. (COMM.) 35/2025 is filed assailing order dated 30.05.2025. 2.
After canvassing some arguments, Mr. Dayan Krishnan, learned Senior Counsel appearing on behalf of the Appellant, on instructions, submits that a fixed deposit shall be made by the Appellant in the sum of Rs.22.62 crores (A/C No. 10484015002314, Punjab National Bank, 8th Floor, DCM Building, Barakhamba Road, New Delhi) marking therein a lien in the name of Registrar General of this Court and the original FDR will ARB. be deposited in a sealed cover with the Registrar General within ten days from today. Additionally, the aforesaid Bank shall be intimated of the lien created and copy of the communication shall be endorsed to the Respondent. 3.
Undertaking of the Appellant is accepted and taken on record. FDR in the sum of Rs.22.62 crores with lien in favour of the Registrar General of this Court shall be deposited in a sealed cover within ten days from today. Sealed cover shall be retained by the Registrar (Original Side) in safe custody. Needless to state that the money under the FDR shall be released depending on the final outcome of the arbitral proceedings. 4.
Appeals along with the enforcement petition stand disposed of along with pending applications.

This petition is filed on behalf of the Petitioner under Order XXI Rule 10 CPC and Section 17(2) of the Arbitration and Conciliation Act, 1996 seeking enforcement of order dated 26.05.2024 passed by the learned Arbitral Tribunal in an application under Section 17 of the 1996 Act. 6.
It is common ground between the parties that a sum of Rs.62.15 crores has been deposited in this Court and is invested in an interest bearing Fixed Deposit.

This petition is accordingly disposed of along with pending applications directing that the money deposited shall be released depending on the final outcome of the arbitral proceedings.
