O.M.P.(MISC.)(COMM.) 64/2024 By way of the present petition filed under Section 29A of the Arbitration and Conciliation Act, 1996, the petitioner seeks an extension of the mandate of the Arbitral Tribunal for a period of six months. Learned counsel for the petitioner submits that the sole arbitrator was appointed by the court on 21.07.2020. It has been submitted that the matter is at the stage of cross-examination of the witnesses. It has further been submitted that the mandate is going to expire on 29.02.2024. Issue notice. Ms.Simran Bajaj, learned counsel has accepted the notice on behalf of the respondent. Learned counsel submits that the counterclaim of the respondent is also pending disposal before the learned arbitrator. Learned counsel for the respondent submits that she has no objection to the extension of the mandate. However, the extension may be granted for the adjudication of the petition as well as the counter claim. In view of the consent of the learned counsels for the parties, the present petition is allowed and the mandate of the Arbitral Tribunal is extended by a period of six months till 30.08.2024. The present petition stands disposed of.
