This hearing has been done through hybrid mode. 2.

This is a petition filed by the Petitioner-Gulshan Lai Chopra under Section 29A(5) of the Arbitration and Conciliation Act, 1996 seeking extension of mandate of the Sole Arbitrator.

As per the present petition, the first Arbitrator, who was appointed, had to be replaced vide order dated 9th December, in O.M.P.

(MISC.)(COMM.) 260/2019 titled 'Jaspal Singh v. Gulshan Lal Chopra'. On 25th August, 2023 the Id. Sole Arbitrator who is now seized of the matter had recorded that the parties had agreed to approach the Court for extension of time for a further period of six months. Ld. Counsel for the- Petitioner submits that the proceedings before the Id. Sole Arbitrator are at the stage of claimant's evidence.

The Respondent has entered appearance and submits that the Petitioners have not pursued the arbitration in a diligent manner. that the reference is of 2018 and the Respondent objects to the mandate being extended.

Considering the fact that the matter is at the stage of evidence of the claimant, the mandate of the Arbitrator is extended till 31st December, 2024. 6.

After having perused the order sheets, it is made clear that if any of the parties seeks adjournment, cost of the said hearing shall be borne by the said party seeking adjournment. No unnecessary adjournments shall be taken by either of the parties.

List before the Arbitrator on the date fixed i.e. on 15th March, 2024. 8.

The petition is disposed of.
