Pursuant to the order passed by this Court on 17th September, 2025, Mr. Khan, counsel appearing on behalf of the plaintiff has returned with instructions stating that the plaintiff is agreeable to withdraw the present suit, since the agreement between the plaintiff and erstwhile defendant no. 3, M/s Beauty & Business S.P.A, has expired.

He seeks liberty to initiate fresh legal proceedings against defendant no. 1 in the event the plaintiff comes across fresh documentary evidence giving rise to cause of action against defendant no. 1. 3.
Counsel appearing on behalf of defendants no. 1 and 2 are agreeable to the same.

In view thereof, the suit is dismissed as withdrawn with the aforesaid liberty.

Pending applications stand disposed of.

In view of the fact that the suit has been withdrawn at an early stage, the Registry is directed to issue a certificate of refund of 50% of the Court Fees in favour of the plaintiffs, in terms of Section 16 of the Court Fees Act, 1870.
