The suit has already been settled qua the defendant no.1. 2.

Counsel for the defendant no.2 submits, on instructions, that the defendant no.2 has no objection if a decree of permanent injunction is passed in favour of the plaintiff and against the defendant no.2. 3.

Counsel further submits that the defendant no.2 is agreeable to pay costs of Rs.1 lakh to the plaintiff.

The same is agreeable to counsel for the plaintiff. 5.

Accordingly, a decree of permanent injunction is passed in favour of the plaintiff and against the defendant no.2 in terms of prayer clauses 58 (c), (d), (e) and (f) of the suit.

Further, the defendant no.2 shall also pay costs of Rs.1 lakh to the plaintiff within three days.
