The Bail Application under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'CrPC') read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') has been filed by the Petitioner, Kashif Athar, for grant of second Anticipatory Bail.

It is submitted that earlier Transit Bail Application had been disposed of vide Order dated 09.01.2024 whereby this Court had granted protection The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. till 23.01.2025, to approach the Court in Ghaziabad/Uttar Pradesh. It is submitted that the Anticipatory Bail Application was filed before the learned District and Sessions Judge, Ghaziabad but the same was dismissed on 21.01.2025. Thereafter, the Anticipatory Bail Application has been filed on 24.01.2025, before the High Court of Judicature at Allahabad, though, it could not be listed on account of technical defect. 5.

A prayer is made that further protection be granted till the Anticipatory Bail gets listed before the High Court of Judicature at Allahabad.

Learned APP for the State, has opposed the Application on the ground that the same is not tenable in this Court.

Submissions heard and the record perused.

The protection has already been granted by this Court till 23.01.2025. There is no provision for further extension of the protection. The Petitioner has already approached the Court of Sessions at Ghaziabad and has also moved an Anticipatory Bail Application, before the High Court of Judicature at Allahabad.

Once the appropriate forum has already been approached, this Court has no further jurisdiction to grant further extension or protection.
