The petitioner is a trained commercial pilot who was appointed as a Trainee Captain with respondent no.1 on 12.02.2025 under an employment agreement, subject to DGCA regulatory framework. 2.

Learned counsel for the petitioner submits that in month of September, 2025, a show cause notice was issued to the petitioner. respondent no. 1. As per the petitioner, the same did not constitute resignation. According to him, the communication was made on the internal employee portal and therefore, the same is in the possession of respondent no. 1. The petitioner also submits that respondent no.1 has refused to issue the mandatory No Objection Certificate, Accident/Incident records, and statutory service and safety records, and also withheld his salary, expressly linking the same to recoveries of certain alleged dues. 3.

He submits that the petitioner made various applications to respondent no.1 and respondent no.2-DGCA, however, respondent no. 2 has failed to pass any order.

Having considered the nature of the grievance raised by the petitioner, the Court finds that respondent no.2, as of now, will be the appropriate authority to consider the petitioner's grievance and to pass an appropriate order.

Accordingly, the instant petition stands disposed of with the following directions:

i.

Let the petitioner to file a fresh representation to respondent no.2 within seven working days from today.

ii.

On receiving the petitioner's representation, let respondent no.2 to pass an appropriate order after affording opportunity of hearing to the petitioner and respondent no.1.

iii.

Let the said exercise be carried out within a period of two months from the date of receipt of the copy of the representation.
