% 15.01.2020 The present petition is one under Section 439 of the Cr.P.C., 1973 seeking grant of interim bail in relation to FIR No. 28/2016, PS Special Cell (SB) Delhi for a period of two months under Sections 18/29/61/85 NDPS Act.
The submissions that have been made through the application vide Ground G were to the effect that the son of the petitioner was suffering from various health problems and has stones in the kidney and needed a caretaker for the same for the surgery to be performed. A status report dated 13.11.2019 under the signatures of Inspector Kuldeep Singh, Special Cell/NR was submitted to the effect that the verification had been done from Shri Aala Hazarat Surgical & Trauma Center, Bareilly, UP which had verified the factum of calculus of 7.2mm but no date of surgery had been given and that the patient wanted the surgery to be performed on 12.10.2019 and that the
patient did not come in hospital after 19.9.2019. It has been submitted on behalf of the petitioner in reply to a specific Court query by the learned counsel for the petitioner that there is no date of surgery that has been scheduled and that the son of the petitioner who is aged 19 years is now taking Ayurvedic medical treatment. It has further been submitted on behalf of the petitioner that the wife of the petitioner is unwell and in relation thereto it is submitted that the copies of the ailment of the petitioner's wife have been submitted on record which are indicated to have been verified by the State and which indicate that the petitioner's wife is suffering from Tonsil and has been advised operation for 10.1.2020.
Apparently, the petitioner's wife who has been advised operation on 10.1.2020 has an adult son aged 19 years who can look after her, the prayer seeking grant of interim bail is declined. The bail application is disposed of.
