O R D E R

% 25.07.2018 The petitioner seeks bail. He has been accused of murder of his friend Pradeep Bisht on 22.02.2014. The body of the deceased was discovered on 24.02.2014 lying in a drain (naala) near Mansarovar Hostel in Delhi University. The postmortem report showed that he had 13 injuries all of which were ante mortem. The father of the deceased had lodged a complaint a day prior, stating that his son was missing. The father had also mentioned that in the evening of 23.02.2014 Rinku, a friend of the deceased, had come to his residence at 5.00 p.m. The deceased and Rinku left the house together. Rinku's mobile detail showed that there had been contact between the deceased and him. The ID cell location has also corroborated their presence in the area.

According to the case of the prosecution, Rinku had disclosed that he and his friend i.e. the petitioner herein, had eliminated the deceased because the latter was making amorous advances towards Rinku's love interest.

Pieces of broken beer bottles were also recovered from the site. It is the prosecution's case that these pieces are evidence that the bottles were used to fatally injure the deceased. It is the prosecution's case that Dr. Arun Kumar (PW18), who conducted the postmortem of the deceased, has deposed that the cause of death is the combined effect of cerebral damage produced by blunt force trauma and asphyxia due to drowning which were individually and collectively sufficient to cause death in ordinary course of nature.

In view of the above, the Court finds no reason to grant bail to the petitioner. The petition is dismissed.
