The matter has been received on transfer.

This is a petition seeking grant of parole for a period of 3 months. 3.

In the present case, the petitioner was convicted under section 302/201/34 IPC in relation to the FIR No. 592/2007 registered at P.S Mehrauli, Delhi and has been sentenced to undergo Life Imprisonment by the Ld. Trial Court.

As of today, the petitioner has already undergone 15 years 7 months 2 days and has a remission of 1 year 8 months 26 days. 5.

The petitioner moved an application for parole which was rejected by the competent authority on 03.01.2025 under Rule 1210(v) of Delhi Prisons Rules, 2018 on the ground that a minimum of 6 months ought to have elapsed from the date of last surrender and he surrendered on 06.10.2024. 6.

In the present case, it has been stated that the wife of the petitioner is having kidney problems and is undergoing haemo dialysis thrice a week. 8.

The same according to me qualifies the petitioner for parole. 9.

For the said reasons, the petition is allowed and the petitioner is directed to be released on parole for a period of 4 weeks from the date of his release with the following terms and conditions: (a) The petitioner shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with 01 local surety in the like amount, to the satisfaction of the Jail Superintendent; (b) The petitioner shall furnish his cellphone number to the concerned Investigating Officer ('IO'). on which the petitioner may be contacted at any time and shall ensure that the number is kept active and switched-on at all times;

(c) The petitioner will furnish his permanent address to the IO and in case he changes his address, he will inform the IO concerned; (d) The petitioner shall not indulge in any act or omission that is unlawful or that would prejudice the proceedings in pending cases, if any.

(e) Upon expiry of the period of parole, the petitioner shall surrender before the Jail Superintendent.

The petition is allowed and disposed of.
