Three separate applications under Section 438 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') have been preferred on behalf of petitioners for grant of anticipatory bail in FIR No. 0486/2022, under Sections 384/34 IPC, registered at PS: Seelampur.

In brief, as per the case of prosecution, FIR was registered on 21.10.2022 on complaint of Amit who alleged that in September 2022, an unknown person was sent by Raj Kumar @ Raju Meena (petitioner in BAIL APPLN. 309/2022), who blackmailed and demanded an amount of Rs. 2 lacs from complainant, failing which, a video of complainant recorded by Raj Kumar @ Raju Meena shall be made viral, wherein complainant is seen taking bribe. An amount of Rs. 50,000/- is further alleged to have been paid by complainant to Sanjay Gupta in presence of Raj Kumar @ Raju Meena. Wasiuddin Ansari @ Shoeb Arshi (petitioner in BAIL APPLN. 3641/2022) is stated to be lawyer of Raj Kumar @ Raju Meena. 3.

Learned counsels for the petitioners submit that all three petitioners were granted interim protection by this Court vide different orders and have already joined the investigation. They further contend that present FIR was registered as a counter to the aforesaid video of demand of bribe by complainant, which is already under investigation. It is emphasized that petitioners are no longer required for the purpose of investigation since the investigation is at concluding stages as informed by learned APP. 4.

Learned APP for the State opposes the applications. He informs that investigation is at concluding stages and chargesheet / final report is to be shortly filed.

Petitioners have already joined investigation and it has been vehemently contended that FIR has been lodged as a counter to surfacing of video in which bribe is being obtained by complainant. Considering the totality of the facts and circumstances, in the event of arrest, petitioners be admitted to bail on furnishing a personal bond in the sum of Rs. 50,000/- (Rupees Fifty Thousand only) each with one surety in the like amount to the satisfaction of IO / SHO, P.S. concerned.

Applications are accordingly disposed of. Pending applications, if any, also stand disposed of.
