The present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/complainant against the orders dated 15.12.2025 and 20.12.2025 passed by the Additional Sessions Judge, South East District, Saket Courts, New Delhi, ["Sessions Court"], by which interim protection has been granted to the accused respondents No. 3 to 5 herein in their application for anticipatory bail.

As the application for anticipatory bail remains pending before the Sessions Court, Mr. Manoranjan Kumar, learned counsel for the petitioner, submits that the petitioner will raise all her contentions before the Sessions Court, including with regard to the procedure followed by The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Ms. Manjeet Arya, learned Additional Public Prosecutor for the State, and Mr Rahul Yadav, learned counsel for the respondents No. 3 to 5, are present. They have no objection to the date of hearing before the Sessions Court being advanced, but Mr. Yadav also seeks to reserve the rights and contentions of respondents No. 3 to 5 before the Sessions Court as the contentions of the petitioner herein are disputed. 4.
Having regard to the aforesaid submissions and the fact that the application of respondents No.3 to 5 remains pending before the Sessions Court, I am of the view that the course suggested by learned counsel for the parties is appropriate, rather than entertaining a petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, at this stage. 5.
Thus, the petition is disposed of with the following directions: a. The petitioner may file an affidavit in reply to the bail application before the Sessions Court by 02.02.2026 with advance service to prosecution and learned counsel for the accused before the Sessions Court.
b. The parties are directed to appear before the Sessions Court on 03.02.2026. The Sessions Court may either take up the application for hearing on the same date, or fixed any date as expeditiously as convenient to it.

It is made clear that this Court has not made any observation, one way or the other, on any of the contentions of the parties, and it is for the Sessions Court to take an appropriate decision in accordance with law. With the aforesaid directions, the present petition alongwith pending applications, stands disposed of.
