1. This is a petition under Section 11 (6) of the Arbitration and Conciliation Act, 1996 („Act‟) filed by the Petitioner against the Respondents seeking the appointment of an Arbitrator to adjudicate the disputes between the parties.

2. It is stated that the mediation has failed.

3. Having heard learned counsel for the parties, the Court is of the view that the existence of the arbitration clause in the Collaboration Agreement dated 20th May, 2013 and its invocation by the notice dated 30th August, 2014 sent to the Respondent is not in dispute.

4. The Court, accordingly, appoints Mr. Raghvendra Singh, Advocate (Mobile No. +919717572557) as sole Arbitrator to adjudicate the disputes between the parties including their claims and counter-claims. The arbitration shall take place under the aegis of the Delhi International

Arbitration Centre („DAC‟). The fees of the learned Arbitrator will be in terms of the Delhi High Court Arbitration Centre (Arbitrators‟ Fees) Rules.

5. The petition is disposed of. A copy of this order be communicated to the Arbitrator as well as Additional Coordinator, DAC forthwith. S.MURALIDHAR, J JANUARY 04, 2017 Rm
