Through the present Petition filed under Article 226 of the Constitution, the Petitioner seeks issuance of a writ in the nature of certiorari for quashing the order dated 22.08.2024 passed by the Respondents.

The Petitioner was initially appointed to the post of Constable in Railway Protection Special Force ('RPSF'). Subsequently, the Petitioner applied for and was selected for the post of Postal Assistant in the Department of Posts. Upon tendering his resignation from the RPSF, which came to be accepted, the Petitioner joined his new post. However, within a short period of four months, he resigned from the said post and sought re-enlistment in the RPSF. past service benefits.

In terms of Rule 275 of the RPF Rules, 1987, the request for reenlistment is to be treated as a fresh recruitment into service, thereby disentitling the incumbent from any claim pertaining to her/his past service benefits.

However, during the course of hearing, the Petitioner, who appeared through video conferencing, along with his counsel and learned counsel representing the Respondents, arrived at a consensus to resolve the present dispute. It has been mutually agreed between the parties that the Petitioner shall be permitted to rejoin service as a fresh recruit, sans any claim to past service benefits, which position has been unequivocally accepted by the Petitioner. 5.

In view of the aforesaid consensus between the parties, no adjudication on merits survives, accordingly, the present Petition is disposed of in terms thereof.

At this stage, learned counsel representing the Respondents has assured the Court that the Petitioner shall be deputed for training in the next available batch.

The aforesaid statement made on behalf of learned counsel representing the Respondents is taken on record. The Respondents shall remain bound by the same and are directed to adhere to it in letter and spirit.
