CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 18.02.2020 1.

None appears for the petitioner.

2.

The petitioner has filed the present petition impugning an order dated 05.10.2019, whereby the petitioner's application for grant of parole was rejected by the concerned authority in view of the Rule 1210 (II) of the Delhi Prison Rules, 2018. It was noted that the petitioner had been imposed a major jail punishment on 14.10.2017 and therefore, in terms of Rule 1210 (II) of the said Rules, he was required to maintain good conduct for a period of two years prior to his application.

3.

The nominal roll has been filed, which indicates that there is no allegation of any unsatisfactory behaviour after 14.10.2017. In this view, the petitioner has complied with the condition of maintaining uniformly good

conduct for a period of two years.

4.

In view of the above, the impugned order dated 05.10.2019 is set aside and the matter is remanded to the concerned authorities to consider the petitioner's application afresh and communicate its decision to the petitioner as expeditiously as possible and, in any event, within a period of two weeks from today.

5.

The petition is disposed of.
