At the outset, Mr. Arun Birbal, learned Standing Counsel for Delhi Development Authority ("DDA") submits that the petitioner had wrongly th challenged the Circular dated 15 January, 2024, attached as Annexure P-1 to the present petition. He submits that the said circular pertains to list of successful H1 Bidders of 'DDA Diwali Special Housing Scheme 2023', with which the petitioner has no concern, as the petitioner has not even applied under the said Scheme.

Considering the aforesaid, learned counsel for petitioner submits that he may be granted liberty to withdraw the present petition in order to make requisite amendments and file a fresh petition on the same cause of action. 6.

Liberty is granted. Accordingly, the present petition is dismissed as withdrawn along with pending application.
