CORAM:
HON'BLE MR. JUSTICE VIBHU BAKHRU
O R D E R
% 23.10.2019 CRL.M.A. 39008/2019 1.
Allowed, subject to all just exceptions.
W.P.(CRL) 3016/2019 2.
The petitioner has filed the present petition, inter alia, praying that he be released on furnishing a Personal Bond and/or depositing cash surety of ₹10,000/- 3.
The petitioner had applied for furlough, which was granted subject to certain conditions. This included furnishing of one surety of ₹10,000/- along with a Personal Bond of the like amount. The petitioner had applied for modification of the said order.
4.
The petitioner states that his parents are of an advanced stage and his
relations with his brother are strained. The petitioner has also a sister. She lives in her matrimonial home. The aforesaid contentions were considered by the concerned authority and the petitioner's request was declined by an order 22.07.2019. The competent authority had noted that the petitioner's family/friends had visited the petitioner on 10.07.2019. 5.
In this view, the contention that no one is willing to stand as a surety for the petitioner raises doubts.
6.
In view of the above, this Court finds no reason to interfere with the impugned order save and except to the extent to reduce to the aforesaid sum of ₹10,000/-, to ₹5,000/-. It is so directed. All other conditions as imposed by the competent authority are required to be complied with. 7.
The petition is disposed of with the aforesaid directions. VIBHU BAKHRU, J OCTOBER 23, 2019 MK
